1. ACCEPTANCE OF THESE TERMS
Welcome to Boost Classifieds (“Boost Classifieds,” “Boost,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of www.boostclassifieds.com, including all websites, applications, marketplace features, listings, memberships, VIP services, vehicle inspection services, promotional services, messaging systems, payment services, and other services provided by Boost Classifieds (collectively, the “Services”).
By accessing or using the Services, creating an account, posting a listing, purchasing a membership, purchasing a promotional service, participating in a vehicle inspection, communicating with another user, or otherwise using Boost Classifieds, you agree to these Terms.
If you do not agree to these Terms, you must not use the Services.
2. CANADA AND UNITED STATES USERS
Boost Classifieds may provide Services to users throughout Canada and the United States.
Because laws differ between Canadian provinces and territories and between U.S. states and federal jurisdictions, these Terms are intended to apply subject to the mandatory laws applicable to you.
Nothing in these Terms is intended to waive, eliminate, restrict, or replace any consumer right, warranty, protection, remedy, or legal requirement that cannot legally be waived or excluded.
If a mandatory law applicable to you conflicts with a provision of these Terms, the mandatory law will control to the extent of the conflict.
Nothing in these Terms prevents you from:
- Contacting a government regulator;
- Filing a consumer complaint;
- Exercising a statutory right;
- Reporting suspected unlawful conduct;
- Cooperating with law enforcement;
- Exercising legally protected rights; or
- Pursuing a remedy that cannot legally be waived.
3. WHAT BOOST CLASSIFIEDS IS
Boost Classifieds operates an online classifieds and marketplace platform.
The platform may allow users to:
- Advertise vehicles;
- Advertise products;
- Advertise services;
- Search listings;
- Contact sellers;
- Communicate with buyers;
- Purchase memberships;
- Promote listings;
- Participate in VIP programs;
- Request vehicle inspections; and
- Access other marketplace features.
Unless expressly stated otherwise, Boost Classifieds is not the buyer, seller, owner, manufacturer, dealer, mechanic, broker, agent, or legal representative of vehicles, products, or services listed by users.
A transaction between users is generally a transaction between those users.
4. USER ELIGIBILITY
You must have the legal capacity to enter into a binding agreement in your jurisdiction to use the Services.
You represent that:
- Information you provide is accurate;
- You have authority to agree to these Terms;
- You will comply with applicable laws;
- You will not use Boost Classifieds for unlawful purposes; and
- You will not use another person's account without authorization.
Boost Classifieds may impose additional age requirements for specific Services.
5. USER ACCOUNTS
Some Services require an account.
You are responsible for:
- Maintaining accurate account information;
- Protecting your login credentials;
- Maintaining account security;
- Activities occurring through your account; and
- Immediately reporting unauthorized access.
You may not:
- Impersonate another person;
- Create an account using false information;
- Create fraudulent accounts;
- Create accounts to evade a suspension;
- Sell or transfer an account without authorization;
- Use another person's account; or
- Manipulate the platform through multiple accounts.
Boost Classifieds may suspend or terminate accounts that violate these Terms or applicable law.
6. CLASSIFIED LISTINGS
Users may post listings for permitted vehicles, products, and services.
By posting a listing, you represent and warrant that:
- You have the legal right to advertise the item;
- The information is accurate and not materially misleading;
- You have the right to use photographs and other content;
- The item is not stolen or unlawfully obtained;
- The listing complies with applicable laws;
- Material defects and other legally required information are properly disclosed; and
- You will honour representations made to prospective buyers.
Boost Classifieds may remove, edit, restrict, reject, or suspend listings that violate these Terms, applicable law, or marketplace policies.
7. PROHIBITED GOODS AND ACTIVITIES
You may not use Boost Classifieds to advertise, sell, purchase, distribute, or facilitate unlawful goods, services, or activities.
Prohibited activity includes, without limitation:
- Stolen property;
- Counterfeit goods;
- Fraudulent documents;
- Illegal drugs or controlled substances;
- Unlawful weapons or restricted items;
- Explosives;
- Fraudulent schemes;
- Pyramid or unlawful investment schemes;
- Hacked accounts;
- Stolen credentials;
- Malware;
- Child sexual abuse material;
- Human trafficking;
- Illegal services;
- Fraudulent vehicle listings;
- Money laundering;
- Phishing;
- Identity theft;
- Fake listings;
- Fake reviews;
- Chargeback fraud;
- Copyright or trademark infringement;
- Transactions designed to evade applicable law; and
- Other goods or activities prohibited by law or Boost Classifieds policy.
Boost Classifieds may maintain additional prohibited-item policies.
8. VEHICLE LISTINGS
Because Boost Classifieds is an automotive-focused marketplace, vehicle sellers have additional responsibilities.
Sellers must accurately represent material vehicle information, including where applicable:
- Year;
- Make;
- Model;
- Trim;
- Mileage;
- VIN;
- Ownership;
- Title;
- Registration;
- Liens;
- Financing;
- Accident history;
- Damage history;
- Salvage/rebuilt status;
- Modifications;
- Mechanical condition;
- Warning lights;
- Known defects; and
- Other material information required by law.
Users must not intentionally misrepresent a vehicle's mileage, ownership, condition, history, title, or other material information.
9. VEHICLE INSPECTION PARTNERS
Boost Classifieds may offer or facilitate vehicle inspections through selected inspection partners.
Boost Classifieds may hand-select automotive enthusiasts and knowledgeable automotive professionals based on their demonstrated automotive knowledge, experience, reputation, skills, and understanding of vehicles.
Inspection partners are intended to provide an assessment of a vehicle based upon the inspection process and information reasonably available to them at the time of inspection.
The selection of an inspection partner by Boost Classifieds does not constitute a guarantee that the inspection partner will identify every defect.
10. 100-POINT VEHICLE INSPECTION
Where offered, Boost Classifieds may facilitate a 100-point vehicle inspection.
The inspection may evaluate various observable components of a vehicle, which may include:
- Engine;
- Transmission;
- Fluids;
- Brakes;
- Steering;
- Suspension;
- Tires and wheels;
- Electrical systems;
- Exterior;
- Interior;
- Glass;
- Mirrors;
- Lighting;
- Safety-related components;
- Undercarriage;
- Body condition;
- Visible leaks;
- Vehicle identification information; and
- Other observable mechanical or cosmetic conditions.
The precise inspection points may vary depending on the vehicle and circumstances.
IMPORTANT:
A 100-point inspection does not mean that every component, defect, problem, or future failure has been identified.
Certain defects may be:
- Hidden;
- Intermittent;
- Inaccessible;
- Undetectable without specialized equipment;
- Outside the scope of the inspection;
- Caused after the inspection; or
- Otherwise impossible to identify during the inspection.
The inspection is a point-in-time assessment, not a warranty or guarantee.
11. CLIENT AND VIP INSPECTION AGREEMENT
Where an inspection is performed as part of a Boost Classifieds Client or VIP transaction, both the Client and VIP acknowledge and agree to the inspection process and its limitations.
By proceeding with the inspection, the Client and VIP acknowledge that:
- The inspection reflects the vehicle's observable condition at the time of inspection;
- The inspection is not a warranty;
- The inspection is not a guarantee of future reliability;
- The inspection may not identify every defect;
- The vehicle may contain hidden or latent defects;
- Information supplied by the seller may be inaccurate or incomplete;
- An inspection partner may make an error or omission;
- Vehicle condition can change after inspection; and
- The decision to purchase the vehicle remains with the buyer.
12. INSPECTION REPORTS AND MISINFORMATION
Inspection reports, photographs, notes, ratings, observations, measurements, and other inspection information are based upon the inspection partner's observations and information available at the time.
Boost Classifieds does not independently guarantee every statement contained within an inspection report.
To the maximum extent permitted by applicable law, Boost Classifieds is not responsible for:
- Misinformation;
- Inaccurate information;
- Incorrect assessments;
- Missed defects;
- Omitted defects;
- Misdiagnosis;
- Incomplete inspections;
- Seller-provided misinformation;
- Inspection-partner errors;
- Third-party information; or
- Defects that could not reasonably be identified during the inspection.
Nothing in this section excludes liability that cannot legally be excluded, including applicable liability for fraud, intentional misconduct, or other non-waivable legal obligations.
13. INSPECTION IS NOT A WARRANTY
A vehicle inspection does not certify that a vehicle is:
- Safe;
- Accident-free;
- Mechanically perfect;
- Defect-free;
- Reliable;
- Suitable for a particular purpose; or
- Free from future mechanical problems.
Buyers are encouraged to obtain an additional inspection from a licensed mechanic or qualified automotive professional before completing a significant vehicle purchase.
14. SELLER DISCLOSURE RESPONSIBILITIES
A vehicle inspection does not eliminate a seller's responsibility to provide truthful information.
Sellers remain responsible for disclosing known material information about their vehicles as required by applicable law.
An inspection does not authorize or excuse:
- Fraud;
- Misrepresentation;
- Concealment of defects;
- Odometer fraud;
- Title fraud; or
- Other unlawful conduct.
15. TRANSACTIONS BETWEEN USERS
Unless expressly stated otherwise, Boost Classifieds is not a party to transactions between users.
Buyers and sellers are responsible for determining:
- Price;
- Payment;
- Delivery;
- Pickup;
- Shipping;
- Taxes;
- Financing;
- Warranties;
- Returns;
- Refunds;
- Title;
- Ownership;
- Inspection; and
- Other transaction terms.
Boost Classifieds does not guarantee that either party will complete a transaction.
16. BUYER RESPONSIBILITIES
Buyers should perform appropriate due diligence before purchasing a vehicle or other item.
This may include:
- Verifying seller identity;
- Inspecting the vehicle;
- Obtaining a vehicle-history report;
- Checking the VIN;
- Confirming ownership;
- Checking for liens;
- Confirming title status;
- Obtaining an independent inspection;
- Confirming payment instructions; and
- Verifying material representations.
17. SELLER RESPONSIBILITIES
Sellers are responsible for:
- Accurate listings;
- Truthful representations;
- Legal advertising;
- Lawful sales;
- Delivery or pickup;
- Applicable taxes;
- Applicable warranties;
- Applicable return obligations;
- Required disclosures; and
- Compliance with applicable laws.
18. BOOSTED AND FEATURED LISTINGS
Boost Classifieds may offer paid promotional services, including:
- Boosted listings;
- Featured listings;
- Premium placement;
- Increased visibility;
- Advertising packages; and
- Other promotional products.
Purchasing promotional placement does not guarantee:
- A sale;
- A particular number of views;
- Leads;
- Inquiries;
- Search position;
- Ranking;
- Exposure; or
- Any specific commercial result.
Boost Classifieds may determine how promotional listings are displayed.
19. MEMBERSHIPS AND VIP SERVICES
Boost Classifieds may offer memberships, VIP programs, subscription plans, and other paid Services.
Membership benefits, pricing, billing frequency, limits, and material features will be presented before purchase.
Memberships are personal to the purchasing account unless otherwise stated.
Membership benefits may not be transferred without authorization.
20. AUTOMATIC RENEWAL
Where a membership automatically renews, Boost Classifieds will disclose the recurring nature of the membership, applicable price, billing frequency, and material renewal terms before obtaining payment information and charging the customer, subject to applicable law.
By expressly agreeing to an automatically renewing membership, you authorize the applicable payment provider to charge your selected payment method according to the disclosed billing schedule.
Boost Classifieds will provide a reasonable cancellation method consistent with applicable law.
For U.S. customers, recurring-payment practices will be operated consistently with applicable federal and state requirements concerning disclosure, consent, and cancellation. The FTC has emphasized clear disclosure of material subscription terms, express informed consent, and cancellation mechanisms that are not unnecessarily difficult.
21. CANCELLATION
You may cancel an automatically renewing membership through the cancellation method provided by Boost Classifieds.
Where a subscription can be purchased online, Boost Classifieds intends to provide an accessible online cancellation process, subject to applicable law.
Cancellation generally prevents future renewal but does not automatically create a refund for a previously completed billing period unless required by law or stated in the applicable purchase terms.
22. REFUNDS
Refunds are subject to:
- The applicable purchase terms;
- The applicable refund policy;
- The nature of the Service; and
- Mandatory consumer-protection laws.
Boost Classifieds will not use a “no refund” provision to eliminate a refund or cancellation right that cannot legally be waived.
Completed promotional Services may generally be non-refundable once delivered, subject to applicable law.
23. PAYMENTS
Payments may be processed by third-party payment providers.
You authorize the applicable payment provider to process authorized transactions.
You may not use:
- Stolen payment credentials;
- Fraudulent payment methods;
- Unauthorized cards or accounts; or
- Payment methods belonging to another person without authorization.
Third-party payment processors may have their own terms and privacy policies.
24. USER CONTENT
“User Content” includes:
- Listings;
- Photographs;
- Videos;
- Descriptions;
- Reviews;
- Comments;
- Messages;
- Logos;
- Business information; and
- Other material submitted to Boost Classifieds.
You retain ownership of User Content you lawfully own.
By submitting User Content, you grant Boost Classifieds a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, format, modify as technically necessary, and use the content to operate, provide, improve, and promote the Services.
You represent that you have the necessary rights to submit the content.
25. PHOTOGRAPHS AND MEDIA
You may only upload photographs, videos, graphics, logos, and other media that you have the legal right to use.
You may not upload media that:
- Infringes copyright;
- Misrepresents an item;
- Violates privacy rights;
- Contains unlawful material; or
- Otherwise violates these Terms.
26. REVIEWS AND RATINGS
Where reviews and ratings are available, users must provide honest and genuine feedback based on actual experiences.
You may not:
- Purchase fake reviews;
- Sell fake reviews;
- Review your own listing deceptively;
- Manipulate ratings;
- Threaten users for reviews;
- Create accounts to manipulate ratings; or
- Post intentionally fraudulent reviews.
Nothing in these Terms prevents a user from posting a truthful review or legally protected opinion.
27. MESSAGING AND COMMUNICATIONS
You may not use Boost Classifieds messaging systems to:
- Spam;
- Harass;
- Threaten;
- Phish;
- Distribute malware;
- Request passwords;
- Request security codes;
- Send fraudulent payment instructions;
- Facilitate unlawful activity; or
- Circumvent platform restrictions.
Boost Classifieds may take reasonable measures to detect fraud, spam, abuse, and security threats.
28. FRAUD AND SCAMS
Users may not engage in:
- Fake listings;
- Fake accounts;
- Identity theft;
- Payment fraud;
- Overpayment scams;
- Fake payment confirmations;
- Chargeback fraud;
- Phishing;
- Money laundering;
- Fraudulent shipping schemes;
- Account takeovers; or
- Other deceptive activity.
Boost Classifieds may cooperate with law enforcement, payment processors, regulators, or other appropriate parties where legally permitted or required.
29. PRIVACY
Your use of Boost Classifieds is also subject to the Boost Classifieds Privacy Policy.
Boost Classifieds will handle personal information in accordance with applicable privacy laws.
Depending on the user's location and the nature of the Services, applicable privacy requirements may differ between Canada, Canadian provinces and territories, and U.S. jurisdictions.
30. ELECTRONIC COMMUNICATIONS
You consent to receiving communications necessary to operate your account and provide requested Services.
These may include:
- Account notifications;
- Security notices;
- Billing notices;
- Listing notifications;
- Transaction communications; and
- Service announcements.
Promotional communications will be handled in accordance with applicable law.
You may unsubscribe from promotional communications where required by law.
31. INTELLECTUAL PROPERTY
The Boost Classifieds name, logos, branding, software, website design, databases, technology, graphics, interfaces, and other platform materials are owned by or licensed to Boost Classifieds unless otherwise stated.
You may not copy, reproduce, distribute, modify, reverse engineer, scrape, sell, or commercially exploit Boost Classifieds intellectual property without authorization.
32. COPYRIGHT AND INTELLECTUAL-PROPERTY COMPLAINTS
If you believe content on Boost Classifieds infringes your intellectual-property rights, you may submit a complaint to Boost Classifieds through the contact information provided below.
Where applicable, Boost Classifieds may maintain procedures for handling copyright notices and other intellectual-property complaints.
33. SCRAPING AND AUTOMATED ACCESS
Without authorization, you may not:
- Scrape listings;
- Copy marketplace databases;
- Harvest user information;
- Use bots to manipulate listings;
- Reverse engineer the Services;
- Circumvent security controls;
- Access restricted systems; or
- Interfere with platform operations.
34. CONTENT MODERATION
Boost Classifieds may review, remove, restrict, disable, or refuse User Content where reasonably necessary to:
- Enforce these Terms;
- Comply with law;
- Prevent fraud;
- Protect users;
- Protect the platform;
- Address security concerns;
- Remove prohibited material; or
- Maintain marketplace integrity.
We may use automated systems, human review, or both.
35. ACCOUNT SUSPENSION AND TERMINATION
Boost Classifieds may suspend or terminate accounts for legitimate reasons, including:
- Fraud;
- Abuse;
- Security threats;
- Safety concerns;
- Illegal activity;
- Repeated violations;
- Payment fraud;
- Circumvention of restrictions; or
- Violations of these Terms.
Where appropriate and legally required, Boost Classifieds may provide notice or an opportunity to resolve an issue.
Boost Classifieds may take immediate action when reasonably necessary to protect users, the platform, or the public.
36. THIRD-PARTY SERVICES
Boost Classifieds may integrate with third-party services, including:
- Payment processors;
- Vehicle-history providers;
- Inspection providers;
- Mapping providers;
- Advertising platforms;
- Analytics services; and
- Other service providers.
Third-party services may have separate terms and privacy policies.
Boost Classifieds is not responsible for third-party services except to the extent responsibility cannot legally be excluded.
37. NO GUARANTEE OF MARKETPLACE ACTIVITY
Boost Classifieds does not guarantee that:
- A listing will receive views;
- A listing will receive inquiries;
- A vehicle will sell;
- A seller will receive offers;
- A buyer will find a desired vehicle;
- A promotional service will generate leads;
- A membership will result in a particular financial benefit; or
- The platform will generate any particular commercial outcome.
38. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.
Boost Classifieds does not guarantee that:
- Listings are accurate;
- Users are trustworthy;
- Transactions will be completed;
- Vehicles are defect-free;
- Inspection reports are error-free;
- Promotional services will produce specific results;
- The website will always be available;
- The platform will be uninterrupted; or
- The Services will meet every user's requirements.
Nothing in these Terms excludes any warranty, consumer guarantee, statutory protection, right, or remedy that cannot legally be excluded or limited.
39. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Boost Classifieds and its owners, officers, directors, employees, contractors, affiliates, agents, licensors, inspection partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services or interactions between users.
This may include, where legally permitted:
- Lost profits;
- Lost revenue;
- Lost business opportunities;
- Loss of data;
- Transaction losses;
- Vehicle repair costs;
- Losses resulting from another user's conduct;
- Reliance on third-party information; and
- Reliance on inspection information.
Where permitted by applicable law, Boost Classifieds' aggregate liability relating to a paid Service will not exceed the greater of:
(a) the amount paid by you to Boost Classifieds for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim; or
(b) CAD $100 or the equivalent amount in U.S. dollars.
EXCEPTIONS
Nothing in this section limits liability that cannot legally be limited or excluded.
40. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Boost Classifieds and its owners, officers, directors, employees, contractors, affiliates, agents, licensors, and service providers from claims, damages, liabilities, losses, costs, and reasonable legal expenses arising from:
- Your unlawful use of the Services;
- Your violation of these Terms;
- Your User Content;
- Your listings;
- Your infringement of another person's rights;
- Your fraudulent conduct;
- Your transactions with another user; or
- Your violation of applicable law.
This section does not require indemnification for Boost Classifieds' own conduct where such indemnification would be prohibited by applicable law.
41. DISPUTES AND CONSUMER RIGHTS
Boost Classifieds encourages users to contact customer support first to attempt to resolve disputes.
Nothing in these Terms prevents a consumer from exercising rights that cannot legally be waived.
Nothing in these Terms prevents a user from:
- Filing a complaint with a regulator;
- Contacting law enforcement;
- Pursuing a legally available claim;
- Exercising a statutory right; or
- Seeking a remedy required by applicable law.
Any arbitration provision, class-action waiver, or mandatory dispute-resolution provision used by Boost Classifieds will apply only to the extent permitted by the law applicable to the particular user and transaction.
42. GOVERNING LAW
These Terms are intended to operate across Canada and the United States.
For Canadian users, applicable federal, provincial, and territorial laws may apply depending upon the user's location and transaction.
For United States users, applicable federal and state laws may apply depending upon the user's location and transaction.
Where mandatory law provides additional consumer rights, those rights remain unaffected.
43. CONSUMER-PROTECTION SAVINGS CLAUSE
Nothing in these Terms is intended to limit mandatory consumer protections.
If any provision conflicts with a mandatory law applicable to a user, that law will control to the extent of the conflict.
If a provision is found to be invalid or unenforceable, it will be modified or limited to the minimum extent necessary to make it enforceable while preserving its intended purpose.
44. CHANGES TO THESE TERMS
Boost Classifieds may update these Terms from time to time.
The “Last Updated” date will be changed when material updates are made.
Where required by applicable law, Boost Classifieds may provide additional notice or obtain affirmative consent to material changes.
Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
45. CHANGES TO PAID SERVICES
Boost Classifieds may modify memberships, promotional services, features, prices, or other paid Services.
Where a change materially affects an existing subscription and applicable law requires notice, cancellation, refund, or consent, Boost Classifieds will comply with those requirements.
46. FORCE MAJEURE
Boost Classifieds will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including:
- Natural disasters;
- Internet failures;
- Telecommunications failures;
- Power outages;
- Cyberattacks;
- Government actions;
- War;
- Civil unrest;
- Labour disputes;
- Third-party failures; or
- Other extraordinary circumstances beyond reasonable control.
This section does not limit rights that cannot legally be limited.
47. SEVERABILITY
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will remain in effect.
48. NO WAIVER
Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision later.
49. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without authorization.
Boost Classifieds may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or similar corporate transaction.
50. ENTIRE AGREEMENT
These Terms, together with the Boost Classifieds Privacy Policy and any policies expressly incorporated into these Terms, constitute the agreement governing your use of the Services.
Specific purchase terms displayed at checkout may supplement these Terms.
If specific terms conflict with these Terms, the specific terms will control for that particular transaction to the extent permitted by applicable law.

52. FINAL ACKNOWLEDGEMENT
BY ACCESSING OR USING BOOST CLASSIFIEDS, CREATING AN ACCOUNT, POSTING A LISTING, PURCHASING A MEMBERSHIP, PURCHASING A PROMOTIONAL SERVICE, PARTICIPATING IN A VIP PROGRAM, REQUESTING OR ACCEPTING A VEHICLE INSPECTION, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS, SUBJECT TO ALL MANDATORY RIGHTS AND PROTECTIONS PROVIDED BY THE LAWS APPLICABLE TO YOU.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE BOOST CLASSIFIEDS.
